Aadhaar: Constitutional Bench To Valdiate Linking Of Aadhar With Mobile

The Supreme Court has directed banks and mobile service providers to specify the last date for linking their bank accounts and mobile number with Aadhaar in their messages to consumers to avoid creating panic.

On that subject, the Centre in its affidavity submitted that as per the Supreme Court order in Lokniti Foundation v. Union of India, Aadhaar-based E-KYC verification of mobile subscribers was required to be done by February 6, 2018.

When the government denied that such messages were being sent, one of the judges, Justice AK Sikri commented: "Initially I didn't want to say because the press is here, but I am also receiving such messages".

The Bench told the A-G, "If the deadline for Aadhaar linkage is extended till December 31, why are banks issuing these instructions". And today the Supreme Court to hear the petitions against the Aadhaar Card validity.

Earlier on 25 October the Centre had informed the apex court that the deadline for mandatory linking of Aadhaar to receive benefits of government schemes has been extended till March 31, 2018 for those who don't possess the unique biometric identification number but were willing to enroll for it.


"Since hearing in the case would start in the end of November and (the bank deadline is) December 31, 2017. there is no need for any interim order".

In its fresh affidavit, the Centre said: "Until March 31, existing bank accounts will not be made non-operational for not linking with Aadhaar".

The Bench has tagged these petitions with the existing ones challenging the Act, and has asked the parties concerned to approach the concerned Bench and make necessary requests.

The government's assertion acquires significance considering that the SC had on Monday sought the government's response in next four weeks while hearing a separate petition challenging the mandatory linking of mobile phones with Aadhaar.

In an affidavit filed before the apex court, the Centre also said production of Aadhaar was mandatory for opening new bank accounts.
